Terms of Service (WikiPlatform)

Acceptance of Terms

Welcome to WikiPlatform (the “Platform”). By accessing or using WikiPlatform, you agree to comply with and be bound by these Terms of Service (“Terms”). These Terms form a binding legal agreement between you (the user) and WikiPlatform’s operator. If you do not agree with these Terms, you must not use the Platform. Use of the Platform is also subject to our Privacy Policy (which describes how we handle your data), and by using the Platform you acknowledge that you have read and accepted both documents. The Platform is accessible globally, so you agree to abide by all applicable laws in your jurisdiction and internationally when using WikiPlatform.

About WikiPlatform: WikiPlatform is an online service for creating and sharing profile pages. Users can submit content (such as biographical or organizational profiles) which will be publicly displayed on the Platform. WikiPlatform is primarily a profile submission and display platform, and is not designed as a social networking, messaging, or real-time communication service. Any interactive features (such as commenting or messaging) are limited or non-existent; the focus is on contributing and viewing profile content. By using the Platform, you understand and accept that content you submit will be publicly visible and not private.

Eligibility (Age and Jurisdiction)

Minimum Age: You must be at least 13 years old to use WikiPlatform in most countries, and at least 16 years old if required by the laws of your country (for example, 16 in parts of the EU). If you are under the age of 18, you affirm that you have the consent of your parent or legal guardian to use the Platform, and that they have read and agreed to these Terms on your behalf. Users under the age of majority should only use the Platform under parental supervision and consent when required by law. WikiPlatform is not intended for use by children under 13, and such use is prohibited.

Global Use and Compliance: WikiPlatform is accessible worldwide. You are responsible for ensuring that your use of the Platform is legal in your country or jurisdiction. You agree to comply with all applicable laws and regulations when using the Platform, including laws relating to online conduct, content, and the export of data or software. You must not use the Platform if you are in a country embargoed by applicable export laws or if you are prohibited by law from using the services (for example, if you are on a sanctions list). By using WikiPlatform, you represent that you are not located in or a citizen of any country subject to trade sanctions, and that you are not on any government list of prohibited or restricted parties.

User Accounts and Registration

Account Creation: To contribute content on WikiPlatform, you may need to create a user account. When registering, you agree to provide truthful, accurate, and current information. You may be required to verify your email or identity as part of the signup process. You must not impersonate anyone or provide false details when creating an account. We may refuse registration, or cancel a username that violates someone’s rights or our policies (for example, offensive or misleading names).

Account Security: You are responsible for maintaining the confidentiality and security of your account login credentials. Do not share your password with others. You agree to notify us immediately if you suspect any unauthorized access to or use of your account. You are solely responsible for all activities that occur under your account, whether or not you authorized them. WikiPlatform will not be liable for any loss or damage arising from your failure to safeguard your account (for example, if someone gains access to your account due to your lax security). We encourage you to use a strong password and enable any available security features.

Account Use and Restrictions: Each user should generally have only one account (unless explicitly permitted otherwise). You may not create an account if we have previously banned or terminated you without our permission to return. Using automated means to create accounts or using false identities is prohibited. If account profile or verification is required, you agree to keep your contact information up-to-date.

Account Suspension or Termination: WikiPlatform reserves the right to suspend or terminate your account at any time, with or without notice, if you violate these Terms or for any other reason in our sole discretion. This means we can disable your access to the Platform or certain features if we believe you have breached the rules or if we decide to discontinue the service or your account. In such cases, we may deactivate or delete your account and remove or disable your content. We also reserve the right to refuse service or access to anyone at any time, at our discretion. (If you believe your account was terminated in error, you may contact us to dispute the decision, but reinstatement is not guaranteed.)

Account Deletion by You: You are free to stop using WikiPlatform at any time. If you wish to delete your account, the Platform may provide a mechanism to do so (or you can contact our support for assistance). Deleting your account will remove or anonymize personal profile information associated with it, and your ability to log in will cease. However, note that content you have submitted (profiles, contributions, etc.) may remain on the Platform unless you also delete that content (see next section on content deletion). Additionally, for legal and technical reasons we may retain certain information after account deletion (for example, server backups, logs, or archival copies) for a period of time as required for legitimate interests such as security, backups, or record-keeping. We will handle any personal data in accordance with our Privacy Policy.

User Content and Contributions

Your Content: “User Content” refers to any information, text, images, or other material that you submit, post, or contribute to WikiPlatform (for example, profile pages or any edits/suggestions you make). You retain ownership of any intellectual property rights in the content that you create and submit to the Platform; WikiPlatform does not claim ownership over your original contributions. However, by submitting content, you give WikiPlatform certain rights to that content as described below.

License to WikiPlatform: By submitting or posting content on the Platform, you grant WikiPlatform a worldwide, non-exclusive, royalty-free, perpetual license to use, host, store, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display your content (in whole or in part) for the purpose of operating, improving, or promoting the Platform. This license allows us, for example, to display your profile pages to other users, to reformat or edit your content for clarity or compliance with our guidelines, to use excerpts in promotional materials, or to create backup copies of the data. The license to WikiPlatform continues even if you remove your content from the Platform, but will not be used for new purposes outside the Platform’s operation without your permission. (In other words, removing your content will not retroactively undo any actions WikiPlatform took under this license while your content was available.)

Public Content and License to Other Users: Content you contribute to WikiPlatform is generally intended to be public. By default, other users and visitors will be able to view the content you post. In many cases, content on WikiPlatform may be made available under an open content license (for example, a Creative Commons license) to allow others to share or reuse the information. If such a license applies, it will be indicated on the site or in relevant policies. By contributing, you agree that your content may be publicly accessible and that other users may quote, utilize, or reference it in accordance with the applicable license or copyright exceptions (such as fair use). Do not submit any content that you wish to keep private or proprietary, because WikiPlatform is a public platform and we are not obligated to treat any content you post as confidential or secret.

Your Responsibilities for Content: You are solely responsible for all content you contribute and for ensuring that it complies with these Terms and applicable laws. This means:

  • You have the necessary rights to the content. You represent and warrant that you either own the content (e.g., you wrote it or created it yourself) or you have obtained all necessary permissions, licenses, or consents from the rightful owner to submit it. For example, if you upload a photo or text that someone else created, you must have the creator’s permission or the content must be in the public domain or under a free license that allows your reuse. You must not post content that infringes anyone’s copyrights, trademarks, or other intellectual property rights. (See Prohibited Conduct below for more on this.) You also agree that you have the right to grant WikiPlatform the license described above for any content you submit.
  • Content standards: You must ensure that your content is accurate (to the best of your knowledge), relevant, and lawful. You are responsible for the quality and integrity of the information you contribute. Do not post false or misleading information. If your content includes factual claims, whenever possible ensure they are verifiable or supported by reliable sources. Do not include any sensitive personal information about yourself that you do not want public, and do not include personal information about others without their consent or if it violates their privacy rights. For example, do not post someone’s private contact details or personal data in a profile unless it’s lawful and you have permission.
  • No violation of privacy or publicity rights: If your content involves someone other than yourself (for instance, you are creating a profile about another person or entity), you are responsible for ensuring that sharing that information is lawful. You should not post someone’s private information (such as personal phone numbers, addresses, or confidential details) without authorization. Profiles of living individuals or organizations should contain only information that is public, commonly known, or provided with consent, and must be presented in a fair and respectful manner. Any content that violates another person’s privacy, portrays them falsely, or could harm their reputation unlawfully is prohibited.

Editing and Removing Your Content: WikiPlatform may allow you to edit or delete content that you have contributed (for example, you might be able to update a profile you posted, or remove it). We encourage users to keep their submissions up to date. You may edit your own contributions through the provided tools, as long as you continue to follow the Terms. In general, you may also delete content you have submitted, but note the following exceptions and acknowledgements:

  • Archival Copies: Even if you delete content from public view, WikiPlatform may retain backup or archival copies of that content on our servers for a period of time. This is typically done for legitimate purposes such as data backup, restoring service, or legal compliance. These retained copies will not be visible to the public but might persist in our system for some time. We will purge them in accordance with our data retention policies.
  • Public Copies and Forks: Content that was publicly available might have been viewed or copied by others while it was live. WikiPlatform cannot control and is not responsible for what other users or third parties do with content that you have made public. For example, if someone else has copied text from a profile you wrote and published it elsewhere (under a permitted license), your removal of the original on WikiPlatform will not automatically remove the copy on the third-party site. Other users or sites may retain copies of your content even after you delete it from WikiPlatform. By contributing content, you acknowledge this possibility. (If you have a specific concern, such as a privacy request for removal, you can contact us and we will evaluate it, but we cannot guarantee complete erasure of published content across the internet.)

In summary, think carefully before posting content and only publish content that you have rights to share and that you are comfortable making public. If you choose to remove content, we will endeavor to respect your request on our Platform, but these Terms recognize that some residual use (such as cached copies, backups, or lawful reuse by others) may continue.

Content Moderation and Removal

No Pre-Screening: WikiPlatform is an open content platform and does not generally pre-approve or pre-moderate user contributions before they are published. We are not responsible for actively screening or monitoring every user submission. That means content is largely contributed in real time by users without advance verification by WikiPlatform. However, we reserve the right to monitor the Platform for compliance with these Terms and to protect the service and users.

Right to Remove or Modify Content: WikiPlatform reserves the right (but not the obligation) to review, screen, and/or delete any user content at any time at our sole discretion. If we believe content violates these Terms, infringes the law, is offensive, or for any other reason is objectionable, we may remove it or edit it. Such removal or editing might occur with or without prior notice to the user who provided the content. We may also disable access to content (for example, by making it private or unindexed) or restrict editing capabilities on certain content if needed to enforce our policies. You have no guaranteed right to keep any specific content posted on the Platform; WikiPlatform can take down content at any time as we deem necessary. That said, we are not responsible for issuing prior warnings or explanations, though we may attempt to do so when feasible.

Automated Moderation Tools: To help enforce our standards, WikiPlatform may employ automated tools or algorithms (including AI-based content filters, spam detectors, or image recognition tools) in addition to human moderators. These tools can assist in identifying content that might violate our Terms or content guidelines. For example, we might use automated classifiers to detect spam or profanity, or to flag copyright-infringing uploads. You acknowledge that such tools may be used and that some decisions in content moderation might be handled initially by automated systems. However, final moderation decisions may involve human review, especially for complex or disputed cases. Automated systems are not perfect, so if you believe your content was wrongfully removed or flagged, you can contact us to request a review.

No Liability for Content or Removal: WikiPlatform is not liable for content posted by users, whether for its accuracy, legality, or appropriateness. User Content is the sole responsibility of the person who contributed it. We provide the platform for users to share information, but we do not guarantee the truthfulness or quality of any content. Use of content is at your own risk – see the Disclaimers section for more. Additionally, we are not liable for any action we take (or fail to take) regarding moderation. This means we are not responsible if we do not remove a piece of content that you find objectionable, and we are also not responsible to you if we do remove something that you posted (whether or not you believe it was justified). We make moderation decisions in good faith to the best of our abilities, but the choice to remove, edit, or allow content is ours and by using the Platform you agree we shall have no liability for the consequences of those decisions.

User Reporting: We encourage the community to maintain quality. There may be mechanisms for users to report content or behaviors that violate these Terms (for example, a “Report” button or contact email). If you become aware of content that you believe breaches our policies or is unlawful, please notify us through the designated channels. We will review reports and take action as appropriate in our discretion. Knowingly submitting false or abusive reports, however, is itself a violation of these Terms.

Appeals: If your content is removed or your account is suspended and you believe this was a mistake, you may contact WikiPlatform support to request an explanation or appeal the decision. We will review appeals case-by-case. However, decisions by WikiPlatform (and its moderators or staff) are final and made in the interest of the platform’s integrity and compliance obligations.

Prohibited Conduct

To maintain a productive and safe environment, you agree not to engage in any of the following prohibited activities on WikiPlatform. These rules apply to all content you contribute and to your general behavior on the Platform:

  • Illegal Content or Activities: You may not use WikiPlatform for any unlawful purpose or post any content that is illegal. This includes (but is not limited to) posting any material that involves or promotes criminal activity, fraud, or violates any law or regulation. For example, do not post child sexual abuse material or any form of pornography involving minors, and do not encourage violence or criminal conduct. Content that is extremely obscene or otherwise unlawful in the jurisdiction of the Platform or the user is strictly forbidden. You also may not use the Platform to solicit, facilitate, or plan illegal activities.
  • Harassment, Hate, and Abuse: WikiPlatform is intended to be a respectful environment. Do not harass, bully, or threaten others. This includes using hateful language, slurs, personal attacks, or encouragement of self-harm. You may not stalk or single out another person for abuse. Harassing or degrading content directed at individuals or groups on the basis of who they are (race, ethnicity, gender, religion, sexual orientation, etc.) is strictly prohibited. Additionally, spamming others with repetitive content or unwanted messages is not allowed. (While WikiPlatform may not have messaging, this rule applies to any interaction or content posting that could constitute harassment or spam.)
  • Impersonation and False Information: You must not impersonate any person or organization, or misrepresent your affiliation with any person or entity. Do not claim to be someone you are not, and do not post content that is deliberately misleading as to its source. Creating a profile for a person or entity with the intent to deceive or defraud others (for example, a fake profile of a living person that spreads false information) is a serious violation. Parody or fan pages should be clearly marked as such to avoid confusion. Additionally, knowingly spreading false information or hoaxes on the Platform in a manner that could mislead others is prohibited (we distinguish genuine errors or good-faith incomplete information from intentional deception).
  • Privacy Violations and Personal Data Abuse: Do not post private or sensitive information about others without consent. This includes personal data like phone numbers, email addresses, physical addresses, financial information, or intimate photos of someone (especially if they are not a public figure and did not consent). Collecting or harvesting other users’ information (such as through scraping) for any purpose, especially to send unsolicited communications, is forbidden. Also, do not solicit personal information from minors or from any user for exploitative or harassing purposes.
  • Intellectual Property Infringement: Only post content that you have rights to use. Do not upload or submit content that infringes someone else’s copyright, trademark, patent, or other intellectual property rights. This means you shouldn’t copy text, images, or other media from third-party sources unless it’s legally permitted (e.g., it’s public domain, under an open license, or you have permission). If you quote or incorporate external content in a profile (like quoting a snippet from an official bio), provide attribution if required and ensure it’s within fair use or license allowances. If we receive valid copyright infringement notices (DMCA notices or equivalent), we will remove the content and may terminate repeat infringers’ accounts. Similarly, do not use someone else’s trademarks in a confusing or misleading way (such as pretending to be an official representative of a company you’re not associated with).
  • Malicious Software and Technical Misuse: You must not upload or link to any software or executable code that is harmful. No viruses, malware, worms, Trojan horses, or malicious code should be posted on or through the Platform. Also, do not attempt to perform any actions that could harm the technical infrastructure of WikiPlatform or its users. This includes attempting to hack the site, gain unauthorized access to systems or data, circumvent access controls, or disrupt the service. Do not engage in activities like flooding, spamming the site with automated scripts, or imposing an unreasonable load on our servers. Any form of denial-of-service attack, interference with normal page rendering, or introduction of harmful scripts is strictly forbidden.
  • Automated Access and Data Scraping: You may not use bots, spiders, or other automated means to access or scrape data from WikiPlatform without our express permission. The only exception is if WikiPlatform provides an official API or export feature and you comply with its terms. Automated tools that attempt to create accounts or content, or that collect information from the site en masse, are not allowed. (Public search engine indexing is permitted as described in our robots.txt and standard practice, but any abuse of that may be addressed.) We aim to protect user-contributed content; mass copying or republishing of content from WikiPlatform by third parties may violate our terms or the content’s license unless explicitly allowed.
  • Commercial Solicitation and Spam: WikiPlatform is not to be used primarily as an advertising platform. While you may create a profile for a business or yourself that includes factual information (including, say, a link to your official website), do not post promotional content that is overly advertorial, repetitive, or unrelated to the platform’s purpose. Unsolicited promotions, affiliate links, or fundraising messages posted in profiles or anywhere they don’t belong are prohibited. We also forbid posting the same content repeatedly (spam) or mass-mailing users (if such features exist). Chain letters, pyramid schemes, or any kind of fraudulent financial scheme are banned.
  • Paid Contributions and Undisclosed Endorsements: If you are posting content on behalf of a third party for compensation (for example, you were paid to create or edit a profile about a company), some jurisdictions or our policies may require you to disclose this. WikiPlatform may require that paid editors or contributors openly disclose their employer or client to maintain transparency (similar to Wikipedia’s rules on paid editing). Even if not legally required, it is good practice to be transparent about conflicts of interest. In any case, content should be unbiased and factual. Posting intentionally skewed or promotional content at the behest of a paying client, without disclosure, could be considered both spam and a deceptive practice.
  • AI-Generated Content Policy: If you choose to use generative AI tools to help create content for WikiPlatform (for instance, drafting a profile description using an AI), you remain fully responsible for the content. You must review and verify AI-generated text for accuracy and compliance with these Terms before posting. Do not blindly paste AI output without checking it, as AI can produce incorrect or plagiarized information. Where applicable, WikiPlatform may require that AI-assisted content be disclosed or labeled. For example, some communities might ask that you indicate if a page was auto-generated (to maintain trust). If it’s determined that you posted AI-generated content that is not properly disclosed or that fails to meet our quality and originality standards, it may be removed and you could be warned or suspended. In short, AI tools are not an excuse for violating any rules – any content you post is “yours” in terms of responsibility, even if an AI helped write it.

The above list is not exhaustive. Any behavior that is clearly abusive, disruptive, unlawful, or contrary to the spirit of the Platform may be grounds for content removal or account action, even if not explicitly mentioned in these examples. We expect users to exercise common sense and courtesy. WikiPlatform’s community guidelines (if provided separately) and the general “netiquette” of collaborative content creation should be observed at all times.

If you violate any of the above rules, your content may be removed and your account may be suspended or terminated. Serious violations (such as posting illegal pornography or engaging in criminal conduct) will be reported to the appropriate authorities. We aim to create a valuable resource on WikiPlatform, and these rules are in place to protect that goal and our user community.

Intellectual Property Rights

WikiPlatform’s Content and Branding: Aside from the User Content (which you and other users provide), the Platform itself contains content and materials that are owned by or licensed to WikiPlatform. This includes the site’s overall design, graphics, logos, software code, and any content marked as WikiPlatform’s own (such as text in help pages, or any content we as operators provide). All these elements are protected by intellectual property laws. WikiPlatform (the company/organization) retains all rights to its trademarks, logos, branding, and proprietary content. You may not use the WikiPlatform name or logo in a way that confuses others as to your affiliation with the Platform. For example, you cannot create a website or page that appears to be an official WikiPlatform product without permission, nor use our logo in an unauthorized manner. You also cannot remove or alter any copyright notices, logos, or legal marks on the Platform’s pages.

License of User Contributions: Content that you and others contribute might be made available under open licenses (such as a Creative Commons Attribution-ShareAlike license) to enable broad use and sharing. When you contribute, you agree to license your content under whatever default license WikiPlatform specifies for user contributions. (If not otherwise specified, assume that your contributions are under a free and open license similar to Wikipedia’s, which allows others to reuse the content with proper credit.) This open license is what enables WikiPlatform to serve as a public knowledge base. You still own your content, but you license it to the public and to WikiPlatform through these Terms. If you do not want to grant such rights to the public, do not submit content that would require it.

Copyright Infringement Policy: WikiPlatform respects copyright law and expects users to do the same. If you believe that content on our Platform infringes your copyright, you (or your agent) can send us a takedown notice (for example, a DMCA notice if applicable) providing all relevant details. We will respond to legitimate notices by removing or disabling access to the allegedly infringing material and contacting the user who posted it (if required by law). Repeat infringers’ accounts will be terminated when appropriate. Conversely, if you believe your removed content was not infringing, you may send a counter-notice as permitted by law. More details on how to submit these notices can be found in our Copyright Policy (if available) or by contacting us.

Trademarks and Personality Rights: When creating content (such as profiles), you might reference trademarks (like company names) or individuals. Ensure that such references are factual and necessary. Using someone’s trademark in a misleading way (implying endorsement or creation by the trademark owner when that’s not true) is prohibited. Similarly, if you upload images of people or quote individuals, be mindful of their right of publicity and privacy. Do not use someone’s likeness or personal data in a commercial way on their profile without permission if they are a private figure. For notable/public figures, using their name or factual information is generally allowed (e.g., an encyclopedic profile), but still must be truthful and fair. If a rights holder contacts us about content that infringes their trademark or other rights, we may remove or edit that content.

Feedback and Contributions to Platform: If you provide us with any feedback, suggestions, or ideas to improve WikiPlatform (for example, feature requests or design suggestions), you acknowledge that such feedback is given voluntarily and we are free to use it without any obligation to you. We appreciate feedback but are not required to compensate you or acknowledge you for it. Consider it our shared goal to improve the platform.

Disclaimers and No Warranty

WikiPlatform is an aggregation of user-contributed content and is provided to you “as is” and “as available.” We (WikiPlatform and its operators) make no guarantees or warranties of any kind, express or implied, about the service or the content on it. Use of the Platform is at your own risk.

In particular, you should note the following disclaimers:

  • No Guarantee of Accuracy: The content on WikiPlatform is contributed by users around the world. We do not guarantee that any information on the Platform is correct, complete, reliable, or up-to-date. While we strive for high-quality content, profiles and other articles may contain errors or misinformation. They are provided for general informational purposes only. You should not rely on WikiPlatform as your sole source of information. If you need professional advice (for example, medical, legal, financial, or technical advice), you should consult a qualified professional. Any actions you take based on content on WikiPlatform are at your own risk, and we will not be liable for any inaccuracies or omissions in that content.
  • User Responsibility: Content on WikiPlatform is not authored or verified by us (except any content explicitly marked as WikiPlatform official content). We do not endorse or guarantee the truthfulness or reliability of any user-contributed content. Each user is responsible for their own contributions, and those contributions reflect the opinions or knowledge of the users, not of WikiPlatform. Presence of any content on our site does not mean we have vetted or approved it. WikiPlatform disclaims any liability for content provided by users – it is provided “as is.” We also do not guarantee that the content will meet your needs or expectations.
  • No Professional Advice: As noted, any information presented on WikiPlatform is for general knowledge-sharing. It is not professional advice of any kind. For example, if a profile contains health-related information, that is not a substitute for advice from a healthcare professional. If a profile describes a product or a legal situation, that’s not legal or financial advice from us. We urge you to use independent judgment and seek expert counsel if you require specific guidance. WikiPlatform is not liable for how you use the information obtained here.
  • Service Availability: We strive to keep WikiPlatform up and running, but we do not guarantee that the Platform will be available 100% of the time or that it will be free of errors. The service may experience downtime, technical issues, or we may shut it down for maintenance without notice. We do not warrant that the Platform will be uninterrupted, timely, secure, or error-free. We also do not warrant that any defects will be corrected, or that the site will be free of viruses or other harmful components (though we certainly aim to protect our systems). You are responsible for using your own security software and precautions when accessing any website, including ours.
  • Content Quality and Suitability: We make no warranty that the content obtained from WikiPlatform will meet your expectations or requirements. Any material downloaded or otherwise obtained through the use of our service is done at your own discretion and risk. WikiPlatform is not liable for any damage to your computer system or loss of data that results from the download of any content from our site. Additionally, some content on the Platform may be considered objectionable or inappropriate by some readers. By using the site, you understand that you may be exposed to content that you find offensive or incorrect. We are not responsible for the impact of reading or viewing any content on you.

WikiPlatform isn’t liable for any loss or damage arising from your dealings with third-party websites.
  • No Relationship or Endorsement: Nothing on WikiPlatform is intended to create any kind of special relationship (such as fiduciary, confidential, or client relationship) between you and us or between you and any contributor. Also, reference to any specific product, process, or service by trade name, trademark, manufacturer, or otherwise on the Platform does not constitute or imply any endorsement, recommendation, or favoring by WikiPlatform. If a profile is about a company or product, it’s there for informational purposes, not as an advertisement vetted by us.

In summary, WikiPlatform and its services are provided without any warranty of any kind. To the fullest extent allowed by law, we disclaim all warranties and conditions, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade. We also disclaim any warranties that the service will be operable, error-free, secure, or will meet your needs. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above disclaimers may not fully apply to you. But in such cases, we only disclaim warranties to the extent permitted by law.

Limitation of Liability

Limit on Types of Damages: To the maximum extent permitted by applicable law, WikiPlatform’s operators, owners, employees, or affiliates will not be liable to you for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of (or inability to use) the Platform. This includes, without limitation, any damages for lost profits, lost data, lost goodwill, or other intangible losses, even if we have been advised of the possibility of such damages. For example, we are not liable for losses like: the loss of your content or data (use backups for important content), your inability to access the Platform during downtime, any loss of business opportunity or reputational harm due to content on the Platform, or disputes you might have with other users.

Limit on Amount of Liability: In any case, WikiPlatform’s total cumulative liability to you for all claims arising from or related to the service is limited to the greater of: (a) the total amount of fees (if any) you have paid to us for using the service in the 12 months immediately prior to the event giving rise to the liability, or (b) US \$100 (or equivalent in local currency). If you have paid nothing (the service is free), our liability will by default not exceed \$100. This limitation applies collectively to WikiPlatform and its related entities and individuals. This means that if, for example, you sue us for some issue and the law entitles you to damages, the most you could recover from us (including our staff, etc.) is \$100, unless you’ve paid more than that in fees in the last year – in which case your recovery is capped at whatever you paid.

Scope of Limitations: The limitations of liability in this section apply to any theory of liability, whether based on warranty, contract, statute, tort (including negligence), or otherwise. They apply even if a remedy fails of its essential purpose. Some jurisdictions do not allow the exclusion or limitation of liability for incidental or consequential damages, so portions of these limitations may not apply to you. In such jurisdictions, WikiPlatform’s liability is limited to the smallest amount permitted by law.

Release: You agree not to hold WikiPlatform or its affiliates responsible for other users’ actions or inactions. Because the Platform is a venue for content that we do not fully control, you release us from any claims or liability related to any content posted by others or the conduct of others. If you have a dispute with one or more users or third parties, you release WikiPlatform (and our team) from claims, demands, and damages of every kind arising out of or connected with such disputes.

No Class Actions: You agree that any claim against WikiPlatform will be on an individual basis. You waive any right to bring or participate in a class or representative action against us. (For example, you will not combine your claim with others as a group, or seek remedies on behalf of a “class” of users.) This waiver may be subject to legal limitations; if it is found unenforceable, it will be severed to the extent permitted.

No Liability for Force Majeure: We are not liable for any failure or delay in our performance due to causes beyond our reasonable control, such as natural disasters, war, terrorism, riots, government action, labor disturbances, Internet or utility outages, etc. (These are often called “force majeure” events).

Overall, to the fullest extent allowed by law, WikiPlatform’s liability to you is limited. The Platform is provided at no or low cost to users in exchange for these limitations. If you are dissatisfied with any aspect of the service or with these Terms, your sole and exclusive remedy is to stop using WikiPlatform.

Indemnification

You agree to defend, indemnify, and hold harmless WikiPlatform and its parent, affiliates, and their respective officers, directors, employees, and agents (collectively, the “WikiPlatform Parties”) from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees and costs) arising out of or in any way connected with: (a) your use of or access to the Platform, (b) your User Content or contributions, (c) your violation of these Terms, or (d) your violation of any applicable law or regulation.

In plain terms, if your actions or content cause us to be sued or incur any expense, you agree to cover those costs. For example, if you post content that infringes someone’s copyright and we get sued, you may be responsible for our legal costs and any damages. Or if you use the Platform in a way that harms someone and they bring a claim against us, you will indemnify us.

We reserve the right to handle our legal defense however we see fit, even if you are indemnifying us, in which case you agree to cooperate with us. You also agree not to settle any such matter without our prior written consent (because a settlement might impose obligations on WikiPlatform, which we’d need to approve). This indemnification obligation will survive any termination of your relationship with WikiPlatform or your use of the Platform.

Termination of Use

User Termination: You have the right to stop using WikiPlatform at any time. You may also delete your account at any time if you no longer wish to use the Platform (see “Account Deletion by You” above for details and effects). Termination of your account will result in inability to log in and, depending on our data retention policies, eventual deletion of personal data associated with your account (though public contributions may persist as described). If you simply stop using the Platform, note that these Terms will still apply to past usage and any content you left up.

WikiPlatform’s Termination/Suspension Rights: As noted earlier, we reserve the right to suspend or terminate your access to the Platform (or any part of it) at our sole discretion, at any time, for any or no reason. We especially may do so if you violate these Terms or engage in conduct that we believe is harmful to the Platform or its users. We might also suspend the service or your account during investigation of suspected misconduct. In some cases, we might issue you a warning or reach out to resolve an issue before termination; in other cases, we may deactivate your access immediately. WikiPlatform shall not be liable to you or any third party for any termination of your account or blocking of your access to the Platform.

Effects of Termination: If your use of the Platform is terminated (by you or us), the following will occur:

  • We may deactivate or delete your account and all associated data, or bar any further access to such data. You may lose access to any content or information you had provided (unless it was public content that remains available to others). We have no obligation to continue providing the services to you or to retain your content, except as otherwise stated in these Terms or required by law.
  • However, any public contributions you made (like profile content) might remain on the Platform even after your account is deleted, as part of the Platform’s knowledge base, unless we decide or are obligated to remove them. Those contributions may be attributed to an anonymized username or a generic “former user” label. The licenses you granted for your content will continue, so WikiPlatform (and the public, if under open license) can still use your contributions. This is to preserve the value of content that other users may have built upon.
  • All provisions of these Terms that by their nature should survive termination shall survive. This includes sections relating to intellectual property, disclaimers of warranty, limitations of liability, indemnification, governing law, and any licenses you granted us for your content (which are perpetual) – all these remain in effect even after your relationship with WikiPlatform ends.

Discontinuation of the Platform: Separately, WikiPlatform reserves the right to shut down or discontinue any portion of the service or the entire Platform at any time, for any reason. We might do this as part of a reorganization, lack of funding, legal reasons, etc. If the entire service is discontinued, all user accounts may be terminated and content may become unavailable (we might attempt to provide notice or allow content export if possible). The above effects on content and licenses would similarly apply. We will not be liable for any losses resulting from the service being discontinued.

Changes to Terms

WikiPlatform may revise or update these Terms of Service from time to time. If we make changes, we will post the updated Terms on the Platform and update the “Last Modified” date at the top or bottom of this document. In the case of substantial or material changes, we may also provide additional notice (e.g., via email notification to registered users or a prominent notice on our website). All changes are effective when they are posted unless a later effective date is specified.

By continuing to use WikiPlatform after a new version of the Terms has been posted, you agree to the revised Terms. If you do not agree with any amendment, you should stop using the Platform and (if applicable) delete your account. It is your responsibility to check these Terms periodically for changes. We encourage you to review our Terms of Service from time to time so that you understand the conditions that apply to your use of the Platform.

Please note that no modification to these Terms by any party other than WikiPlatform shall be binding unless expressly approved in writing by an authorized representative of WikiPlatform. (For example, you cannot alter the Terms on your own by inserting new provisions in your communications with us, or claim that some practice modifies the Terms unless we’ve officially agreed to it.)

Governing Law: These Terms of Service and any dispute arising from your use of WikiPlatform will be governed by and construed in accordance with the laws of the Province of British Columbia, Canada (and the federal laws of Canada applicable therein), without regard to any conflict of laws principles. We choose British Columbia law as our governing law to provide consistency in interpreting these Terms. If you reside in a jurisdiction that mandates the application of that jurisdiction’s consumer protection or other local laws, then those laws will apply to the extent required by law. Otherwise, the law of our home jurisdiction (British Columbia, where WikiPlatform’s operator is based) will govern. (Note: We strive to comply with laws globally, but we still must designate one set of laws for contract interpretation—typically the laws of our home location.)

Jurisdiction and Venue: You agree that any disputes or claims arising out of or in connection with these Terms or the WikiPlatform service shall be exclusively brought in the courts located in Vancouver, Province of British Columbia, Canada (unless arbitration is required as set forth below). You consent to the personal jurisdiction of such courts and waive any objections to litigating in that venue (such as claims of inconvenience). For example, since we designate British Columbia as the jurisdiction, you agree that any lawsuit related to these Terms must be filed in a British Columbia court in Vancouver, and you consent to that location.

Arbitration: To expedite resolution and control the costs of disputes, you and WikiPlatform agree that, to the fullest extent permitted by law, any dispute, claim, or controversy arising out of or relating to these Terms or your use of WikiPlatform shall be resolved through final and binding arbitration, not by a court trial. Any arbitration shall be conducted by a single neutral arbitrator in Vancouver, British Columbia, in English, and governed by the Arbitration Act of British Columbia or any applicable arbitration rules. No Class Actions: All proceedings in arbitration will be conducted on an individual basis only. You and WikiPlatform agree not to bring or participate in any class action or other representative claim against each other. In other words, you may resolve disputes with us only in your individual capacity, and may not act as a plaintiff or class member in any purported class, consolidated, or representative proceeding. Small Claims Exception: Notwithstanding the above, either party may choose to bring an individual claim in a small claims court of competent jurisdiction (for matters within that court’s monetary limit) as an alternative to arbitration.

If you are a consumer in the European Union, you may have certain mandatory rights to bring an action in the courts of your country of residence under your local consumer protection laws. Nothing in these Terms is meant to override any rights you have under mandatory law in your jurisdiction. However, to the fullest extent permissible, we still designate the law of British Columbia, Canada as the governing law for these Terms and the venue of Vancouver, BC for any proceedings, as stated above.

Time Limits: You agree that any cause of action or claim you may have arising out of or relating to these Terms or WikiPlatform must be commenced within one (1) year after the cause of action accrues; otherwise, such cause of action is permanently barred. (This does not apply where prohibited by law – for instance, certain jurisdictions have longer statutory periods which cannot be contracted away.)

Miscellaneous

Severability: If any provision of these Terms is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of the remaining provisions. In other words, if one clause is invalid, the rest of the Terms remain in effect.

No Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Similarly, any delay in exercising a right or remedy by WikiPlatform does not mean we’ve given up that right. To be effective, any waiver of rights or provisions by WikiPlatform must be in writing. If we do waive a default by you, that does not mean we will automatically waive any later default.

Entire Agreement: These Terms of Service (along with the Privacy Policy and any other guidelines or policies incorporated by reference) constitute the entire agreement between you and WikiPlatform regarding your use of the service, and supersede any prior agreements or understandings (whether oral or written) between you and us concerning the subject matter. You acknowledge that you have not relied on any representation, promise, or statement not expressly set out in these Terms. If there is any conflict between these Terms and any other rules or content on the site, these Terms prevail (except where we have specifically indicated that some other terms apply to certain content or services).

Assignment: You may not transfer or assign any of your rights or obligations under these Terms without our prior written consent. Any attempt by you to assign the Terms without consent will be null. WikiPlatform may assign or transfer its obligations under these Terms freely to an affiliate or in connection with a merger, acquisition, corporate reorganization, or sale of assets. These Terms will bind and inure to the benefit of the parties, their successors, and permitted assigns.

Relationship of Parties: Nothing in these Terms creates a partnership, joint venture, agency, or employment relationship between you and WikiPlatform. You are an independent user of the site, and no confidential, fiduciary, or other special relationship is formed.

Notices: WikiPlatform may provide notices to you via email (to the address associated with your account), through notifications on our website, or through other reasonable means. You are responsible for keeping your contact information up to date. Official legal notices to WikiPlatform should be sent to the contact/address provided in the contact section below (unless we specify a different method for legal notices).

Language: These Terms may be provided in multiple languages for convenience. However, the English version shall be the governing version in case of any conflict or ambiguity between translations.

Headings: Section titles and headings in these Terms are for convenience only and have no legal or contractual effect.

Survival: Provisions of these Terms that by their nature should survive termination (such as indemnification, limitations of liability, disclaimers, governing law, etc.) will remain in effect after termination of your access or account.
